1. About these terms

These terms govern your use of the VitalWatchStudio iPhone app, this website, and what you buy from us. VitalWatchStudio is operated by Lee Kariuki LLLP, Washington State, USA ("we", "us"). By using the app or website or by buying, you agree to these terms. If you do not agree, please do not use them.

You must be at least 18 years old and able to enter a binding agreement where you live. The app is offered in many countries, and you are responsible for following the laws that apply to you. Our Privacy policy explains how we handle information.

2. Wellness information, not medical care

VitalWatchStudio provides descriptive wellness information from the data you choose to include and personal goals you set. It does not diagnose, treat, prevent or cure any condition, does not replace a clinician, and does not monitor you for emergencies. Do not change medication or treatment because of a report. Devices can be inaccurate, data can be missing, and trends are not proof that something is or is not wrong.

For a possible emergency, contact local emergency services immediately. Do not wait for an app reading, a report, a check-in or a reply from us. A normal or missing reading cannot rule out a serious condition.

Coaching is educational and motivational support, not medical, nutrition, mental-health or other licensed professional care.

3. The iPhone app

• Free: the sample report and setup screens are free.
• Annual access: an auto-renewing subscription, billed yearly through your Apple Account, unlocks weekly reports and unlimited exports. The price (about $26.99 per year in the US) is shown by Apple before you confirm.
• Single Health Brief: a one-time purchase that lets you create one complete weekly report (PDF, Markdown and CSV) or one CSV export of up to 31 days. A credit is used when your report is created. Apple cannot restore used or unused Health Brief credits; they stay on your device.

Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your iPhone's Settings, under your Apple Account and Subscriptions. Cancelling stops future renewals; you keep access until the paid period ends, and saved reports stay readable afterwards. Apple handles billing and refunds for in-app purchases; request a refund at reportaproblem.apple.com. Apple's standard Licensed Application End User License Agreement also applies to the app.

We grant you a personal, non-transferable licence to use the app on your own devices. Do not copy, resell or reverse-engineer it.

4. Website purchases (paid through Stripe)

Skill files, $27 one time. A digital product: after payment we share a Google Drive folder of VitalWatchStudio skill files with the email you paid with. It is a single payment and does not renew. You may use the files for yourself and your own business or practice. You may not resell, redistribute or publish them.

Coaching, $97 per month. A recurring monthly subscription for weekly check-ins, discussion and coaching, installation help and support. It renews every month until you cancel. You can cancel at any time by emailing us or through the Stripe receipt link; cancellation takes effect at the end of the period you have paid for, and we do not charge you again. Scheduling is by email. We do not promise a specific outcome, a response time outside business hours, or emergency availability.

Refunds. If you are not satisfied with the skill files, email us within 14 days of purchase and we will refund you. For coaching, email us within 7 days of your first payment, before your first session, for a full refund; after that, payments for a started month are not refundable, but you can cancel to stop future charges. Nothing here limits any refund rights you have under law.

5. Your information and your content

Your health data and reports belong to you. We do not receive what stays on your iPhone. If you send us information, you confirm that you have the right to share it, and you allow us to use it only to provide the service you asked for.

6. Using the service responsibly

Do not use VitalWatchStudio unlawfully, interfere with the app or site, try to bypass purchases, or share files you receive from us in ways that infringe our rights. We own the VitalWatchStudio name, design, software and materials, apart from your data.

7. Availability and changes

We aim to keep the service available but do not guarantee it will be uninterrupted or error-free. Features depend on your device, iOS version, Apple Health permissions and the data you record. We may update the app, website or these terms. If a change is material we will tell you. Continued use after a change means you accept it.

8. Disclaimers and limits of liability

The service is provided "as is" and "as available", and to the extent the law allows we disclaim implied warranties. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for decisions you make based on a report, and our total liability for any claim relating to the service is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence, or affects your rights as a consumer that cannot be waived.

9. Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Please contact us first at admin@leekariuki.com and give us a chance to resolve a problem informally. If we cannot, disputes will be brought in the state or federal courts located in Washington, unless the law gives you the right to bring them elsewhere.

10. Ending your use

You can stop using the service at any time and delete the app. We may suspend or end access if you break these terms or if we stop offering the service, and in that case we will refund the unused part of any prepaid period.
